To Short Sell or Not to Short Sell: What Happens to Real Estate Short Sales if there is No Mortgage Debt Relief?

As of December 31, the Mortgage Debt Relief Act of 2007 is set to expire. Unless Congress acts, all of the remaining debt relief to be provided in 2013 will likely be considered taxable income. A good portion of our business at FLAstay.com involves short sales. Short sales are a very viable option for many underwater homeowners. Many Realtors who do short sales are concerned about the future of short sales. So, Ken, you ask, “Is this the end of short sales?”No.First, let me explain the Mortgage Debt Relief Act: The Act contains a provision that relieves some sellers of federal income tax liability when a lender forgives the difference between the amounts owed on the mortgage vs. that recovered by the lender in the short sale. In short, when a lender waives this deficiency, the debt is forgiven and the lender issues a 1099-C. According to IRS rules, this forgiven debt is considered income and is, therefore, subject to federal tax. Currently, the Act provides protection for owners who short sell a home which qualifies as their primary residence. Thus, there is a fear in the real estate industry that if this provision were to sunset on Dec. 31, 2012, short sales would no longer be a viable option for homeowners.The concern is unwarranted.

Here’s the reality:

1. Many homeowners don’t qualify for protection under the Act now, especially in our Disney-area market where, by definition, primary residences are the exception not the                    rule.

2. There are significant benefits to a short sale with or without the Act. I find, for example, that full deficiency waivers have become relatively commonplace.

3. Lastly, I honestly wonder how much tax sellers actually end up paying with or without the Act.




Reasons to do a Short Sale with or without the Act

If you are an owner of an  investment property or vacation home, you enjoy the potential benefits of   a) getting a deficiency waiver,   b) avoiding foreclosure, and   c) fast-tracking the restoration of your credit to where you could qualify for another mortgage in as little as two years. Let’s face it; a waiver of the deficiency is a much bigger deal than the amount of any tax   consequence. Remember, the deficiency is what you owe the bank whereas the tax liability is what you owe the IRS on the amount of the deficiency. Recently amended       guidelines of Government Servicing Entities or ‘GSE’s,’ including behemoths Fannie Mae and Freddie Mac, provide for a full waiver of the deficiency for most sellers. The ability to complete a short sale with a high degree of certainty of a full release from the debt obligation is the biggest reason I see for short sales to continue as an attractive  option for underwater owners. The advice of a good accountant or tax attorney will continue to be valuable to the short sale owner. When the seller’s lender issues a 1099  upon completion of the short sale, there are options that the seller should ask their tax professional to explore to mitigate the tax liability. If the selling price of the house is   less than the original purchase price, as is most often the case in a short sale, this loss can be used to offset reported income. Alternatively, debts forgiven in a short sale may  qualify under an IRS insolvency exclusion. See IRS Form 982 for details. Mortgage Interest Deduction On the Chopping Block

Monday, November 12, 2012 — The next two years will be a period of big measures coming out of Washington, and REALTORS® have to be prepared for the possibility that the mortgage interest deduction is unlikely to escape unscathed.


That’s the sober warning REALTORS® received from one of the country’s most widely respected political commentators, Charlie Cook of the Cook Political Report.

At the Legislative and Political Forum during the 2012 REALTORS® Conference & Expo in Orlando, Cook joined National Journal White House correspondent Major Garrett for a look at why the national elections earlier this week went the way they did—and what to expect now that President Barack Obama has been reelected and the House and Senate remain split.


“I don’t think MID will be targeted” for cuts by itself to help address the country’s deficit, but “it’s going to get affected, it’s going to change,” Cook told thousands of REALTORS®.


Cook thinks the cap on itemized deductions that Republican presidential nominee Mitt Romney talked about in the last stage of his campaign could very well be the template Congress looks at—likely in the next six months—to help cut the deficit. Whether it’s based on a dollar limit or a percentage limit, itemized deductions, including MID, will be affected, “no doubt about it,” Cook said. “The world is different.”


Garrett pointed to the response on Wall Street, where the stock market lost 400 points the day after the election, as a sign the federal government must come to grips with the deficit. Lawmakers must start by avoiding the fiscal cliff the country faces at the end of the year, when hundreds of billions of dollars in tax cuts expire, Garrett said. Failure to do that could take three percentage points off U.S. GDP and send the country back into recession. “Congress will have to answer [for that],” he said. “Will the political leadership make a premeditated decision to put the economy back into recession?”


Cook said he expects lawmakers to forge a deal before the end of the year on avoiding sequestration—the round of automatic spending cuts that will impact defense and other discretionary spending categories—and take up some type of tax reform in 2013. Both commentators said Republicans woke up to a new country the day after the election, because it was the strength of the demographic shift sweeping the United States that enabled the President to win despite the tepid economic recovery after his four years in office, something that historically has sunk previous incumbents seeking reelection.


Garrett pointed out that Obama managed to win significantly more electoral votes as Romney—332 to 206—even though he lost the white vote “by a landslide,” or about 20 percent.


Against this demographic shift, Garrett said, Republicans can’t stay competitive at the presidential level if they don’t find a new way to talk about issues that are important to the up-and-coming demographics of the country—minorities, young people, singles—or at least, as Cook suggested, not talk about subjects that distract from their core economic message, like the rape issue that was attributed to the losses of two Republican Senate candidates who were otherwise expected to win.



The Day After Election Day in America

Dear friends-

I woke up this morning. The sun rose on a crystal clear, beautiful day. I took the dog for a walk. It was breezy and there was a nice crisp snap in the air. I saw a few other people going about their business – just like any other day.

Liz said, “I don’t want to talk about politics today.” She’s right. The nation’s fiscal crisis and the deep philosophical divide among its political leaders – yes, these will be topics for debate and discussion, but not today.

Thomas Jefferson called this “The Great American Experiment.” And 236 years later, that’s what it still is. In fact, the experiment is still in its infancy. We continue to hit bumps and potholes in the road and deal with the surprises that forever lie around the next bend. A friend told me recently that the church he attended where he lived previously was built in 812. So 236 years, by comparison, is the blink of an eye. There’s so much more history in front of us than behind us.

So the jury is still out on Jefferson’s great experiment. Each year, though, the day after an election day – with its peace and tranquility and uneventful ‘normalcy’ – is a striking reminder that we must be doing something right. It is a day to reflect on the fact that we are blessed to be living in this place and time. That we live in a country, despite the nay-sayers among us, that is the envy of the planet. That we enjoy a freedom that is without parallel in the history of man. That we are a nation of immigrants and of diversity — today is a day to remind ourselves that our diversity is the source of our great strength and our proud identity.

The great experiment continues. Now go enjoy the day.


Rate on 30-year mortgage falls to record 3.49 pct.

The average U.S. rate on the 30-year fixed mortgage touched its record low this week and the rate on 15-year mortgage hit a new record.

The declines followed the Federal Reserve announcement last week that it would buy bonds to try to push mortgage rates lower and stimulate the housing market.

Mortgage buyer Freddie Mac said Thursday that the average rate on the 30-year loan declined to 3.49 percent from 3.55 percent last week. That matched the lowest rate since long-term mortgages began in the 1950s.

The average on the 15-year fixed mortgage, a popular refinancing option, plunged to 2.77 percent, a new record. That’s down from 2.85 percent last week and the previous record low of 2.80 percent.

Cheap mortgages have helped drive a modest housing recovery this year. And the Fed wants to keep those rates low for the foreseeable future as a way to stimulate the economy.

Last week the Fed said it plans to spend $40 billion a month to buy mortgage bonds for as long as it thinks necessary to make home buying more affordable.

Mark Vitner, senior economist at Wells Fargo, said the stimulus likely helped lower mortgage rates this week. And the Fed’s bond purchases will probably push rates down even further over the next six to nine months, Vitner suggested.

“Mortgage rates are going to be lower than they would otherwise,” he said. “Housing looks like it’s going to provide a significant lift to the economy over the next year.”

The market is already benefiting from the lowest rates on record.

Sales of both previously occupied and newly built homes are up from last year. Home prices are rising more consistently. And builders are more confident in the market and are starting to build more homes.

The broader economy is also likely to benefit from a revival in the housing market. When home prices rise, Americans typically feel wealthier and spend more — a point made by Fed Chairman Ben Bernanke when he addressed the new stimulus measures last week.

Still, the housing market has a long way back. Sales and construction rates remain below healthy levels.

And some economists question whether lower rates will make much of a difference. The average rate on the 30-year fixed mortgage has been below 4 percent since early December. So most people who can qualify have likely already taken advantage of the lower rates.

Many people who would like to refinance or buy a home. They are hiring a C.P.A. for freelancers in NYC to make it easy interms of money. Sometimes they still can’t because they fail to meet stricter lending requirements or don’t have enough money to make a down payment.

To calculate average rates, Freddie Mac surveys lenders across the country on Monday through Wednesday of each week.

The average does not include extra fees, known as points, which most borrowers must pay to get the lowest rates. One point equals 1 percent of the loan amount.

The average fee for 30-year loans was 0.6 point, unchanged from last week. The fee for 15-year loans also held steady at 0.6 point.

The average rate on one-year adjustable-rate mortgages was unchanged at 2.61 percent. The fee for one-year adjustable rate loans was steady at 0.4 point.

The average rate on five-year adjustable-rate mortgages rose to 2.76 percent from 2.72 percent. The fee was unchanged at 0.6 point.

Epcot International Food and Wine Festival

The 2012 Epcot Food and Wine Festival, which starts on September 28, has been extended by one day (to 46 days) and will now end on November 12 (not the 11th, as previously announced). New this year will be a Vegan Marketplace called “Terra,” which will feature dishes such as Trick’n Chick’n Curry with Basmati Rice and Chili Colorado with House-Made Chips and Cashew Cheese. Also new this year: Marketplace Chef Tours every Wednesday, during which festival chefs will host a walking-and-tasting tour around World Showcase with stops at several international marketplaces. Guests will taste five marketplace dishes and five beverage items to include beer, wine and cocktails. Beginning August 14, guests can make reservations for Party for the Senses and other special wine and culinary programs. Party for the Senses grand tasting events will take place October 6, 13, 20, 27 and November 3. Additional programs, also requiring separate admission, feature a lineup of renowned winemakers, guest chefs and speakers participating in elegant dinners, luncheons, seminars and wine schools.

Dragon Boat is marked as one of the fastest growing water sport of the day. It stemmed from the clever works of Ancient Chinese that lured a lot water sport enthusiasts from the time of its being. This sport emphasizes teamwork and endurance. It is composed of team of paddlers, a drummer who played as the heartbeat of the dragon boat and a steersman who sweeps the oar and controls the boat. The dragon boat magnificently shows how the crew shift their way up to their goal moving in sync.

Downtown Disney – Happy Haunting Trick-or-Treating in Downtown Disney has been discontinued due to crowds exceeding the space available.

Disney’s Grand Floridian Resort – The Spa is closed but the fitness center is open. Gasparilla Grill & Games (food court) is closed from August 24 – December 16, 2012. The Courtyard Pool is closed from August 24 – December 2012 but the Beach Pool will be open.

Disney’s Magical Express (Airport Shuttle Service) – New luggage procedure for late night arrivals. Luggage service will no longer be available for arrivals to Orlando International Airport after 10:00PM. Collect your luggage at baggage claim and take with you to the Disney’s Magical Express check-in desk.

1. October 1, 2012 – Epcot’s 30th Anniversary. Epcot will be busy . If you go to Epcot today, go because you’ll enjoy being among so many sentimental Disney fans. If you don’t really care about the anniversary, you might prefer Epcot on a less crowded day.


2. Mickey’s Not-So-Scary Halloween Party (Disney’s Magic Kingdom)- 7:00PM to Midnight – September 11, 14, 18, 21, 25, 28, 30, October 4, 5, 8, 11, 12, 14, 16, 18, 21, 23, 25, 26, 28, 30, 31, November 2, 2012. This special event is a lot of fun for families, with rides, trick-or-treating, and fun party type events. These nights require a special event ticket – you cannot enter using your Magic Your Way or Park Hopper tickets. Ticket prices vary with an advance purchase discount offered on select nights. There are a limited TIP: A lot of children dress up for this event but select costumes that will let your kids comfortably enjoy the rides and attractions – remember that October can still be quite warm in Orlando. Warning: The Magic Kingdom will close to the public at 7:00PM on party nights. Magic Kingdom resort area restaurants (Chef Mickey’s, 1900 Park Fare, Whispering Canyon, etc.) will fill their reservations early as people look for something nearby to enjoy after the early park closing.

4. Epcot’s International Food & Wine Festival ~ September 28 – November 12, 2012. This event is included with regular theme park admission; there a few special events related to this festival that have a separate admission fee. The Epcot Food & Wine Festival is very popular as chefs and winemakers from around the world set up booths where you can savor the wonderful flavors offered. You typically can use your Disney Dining Plan meal and snack credits at this event – in fact, many people “hoard” their snack credits just for this event. Warning: This event is very, very popular. Expect Epcot to be busier than usual on weekends as locals and annual passholders come to enjoy the festival.


5. The Eat to the Beat concert series (included with admission) is always a fun part of the Epcot International Food and Wine Festival. Concerts are in the America Gardens Theatre nightly at 5:15. 6:30. & 7:45PM.

Sales of Existing Homes Improve as Prices Rise

According to the National Association of REALTORS®, resales of single-family homes, townhouses, condominiums and co-ops grew 2.3 percent in July from June to a seasonally adjusted annual rate of 4.47 million. Resales jumped 10.4 percent compared with the same month last year. Economists at the association believe sales could reach 5 million next year.
